Antemortem Preneed Cremation Authorization Form
This form may be used by individuals wishing to authorize their own cremation prior to their death. After this form is completed, signed, dated AND witnessed, a copy MUST be provided to the Funeral Home, Crematory and, of course, keep a copy for yourself. Be aware that completing this form does not necessarily guarantee your wishes will be followed. Ohio law gives the person(s) with the "Right of Disposition" the ultimate authority.
APPOINTMENT OF REPRESENTATIVE FOR DISPOSITION FORM
Section 2108.70 through 2108.73 of the Ohio Revised Code allows an individual (known as the Declarant) to name a person or persons [known as the Representative(s) or Successor Representative(s)] to carry out the "Right of Disposition" for the Declarant. Without a written authorization, the Right of Disposition is dictated by Ohio law. For several reasons, caution is urged when using this form. This becomes a legal document when properly executed, giving sole authority to the person(s) named therein. At the time of the Declarant's death, the Representative can choose to exercise their rights or decline them. This form also legally binds the Representative(s) financially for any decisions they make by exercising those rights. This form MUST be signed by 2 non-blood related witnesses OR MUST be Notorized in order for it to become a legally binding document.
